Racismo en Estados Unidos: llamado conjunto de varios mecanismos de derechos humanos de Naciones Unidas

Ante las diversas protestas desatadas en Estados Unidos desde la muerte en manos de policías blancos del ciudadano norteamericano George Floyd en la ciudad de Minneapolis, varios mecanismos de derechos humanos de Naciones Unidas unieron sus voces en un texto colectivo, titulado “Statement on the Protests against Systemic Racism in the United States“. En su excitativa, repudian el discurso de odio y de incitación a la violencia por parte de la máxima autoridad en Estados Unidos, recordándole las obligaciones internacionales en materia de derechos humanos suscritas por Estados Unidos. En este comunicado conjunto, firmado por 44 mecanismos no convencionales de Naciones Unidas, y circulado este 5 de junio del 2020 (véase texto completo), se puede leer que:

The response of the President of the United States to the protests at different junctures has included threating more state violence using language directly associated with racial segregationists from the nation’s past, who worked hard to deny black people fundamental human rights. We are deeply concerned that the nation is on the brink of a militarized response that reenacts the injustices that have driven people to the streets to protest“.

En la parte final de su texto, los diversos mecanismos de Naciones Unidas en materia de derechos humanos recuerdan también la obligación para los Estados de remediar mediante medidas de reparación actos como el perpetrado contra la vida de George Floyd, a la vez que exigen a líderes internacionales que se hayan expresado sobre este asesinato atacar las raíces estructurales de racismo y de la discriminación racial, al indicar que:

Reparative intervention for historical and contemporary racial injustice is urgent, and required by international human rights law. This is a time for action and not just talk, especially from those who need not fear for their lives or their livelihoods because of their race or ethnicity. Globally, people of African descent and others have had to live the truths of systemic racism, and the associated pain, often without meaningful recourse as they navigate their daily lives. International leaders that have spoken out in solidarity with protestors, and with black people in the United States should also take this opportunity to address structural forms of racial and ethnic injustice in their own nations, and within the international system itself“.

En otro comunicado conjunto, también con fecha del 5 de junio, titulado “UN experts condemn modern-day racial terror lynchings in US and call for systemic reform and justice” (véase texto completo) varios expertos en derechos humanos de Naciones Unidas estiman que:

We strongly condemn the killings of Ahmaud Arbery, Breonna Taylor and George Floyd, and call for systemic reform and justice. The latest videos to surface showing white men chase, corner, and execute a young man who was out jogging, or showing an officer kneeling with his weight on a man’s neck for eight minutes shock the conscience and evoke the very terror that the lynching regime in the United States was intended to inspire,” the experts said. “Given the track record of impunity for racial violence of this nature in the United States, Black people have good reason to fear for their lives“.

Se lee también en la parte final de este comunicado la preocupación generada por mecanismos internos policiales en Estados Unidos que favorecen la militarización de los integrantes de las fuerzas policiales; así como por el hecho que el riesgo de verse afectada por el COVID-19 en Estados Unidos es mucho mayor para la población afrodescendiente:

” The experts also recommended that the government of the United States revisit and cease policies facilitating qualified immunity, provision of military equipment to, and military-type training of police, no-knock warrants and use of non-uniformed police in citizen interactions. Finally, civilian oversight boards, mandated body worn camera use, de-escalation training, and independent review of all extrajudicial police killings would enhance both transparency and accountability.

The recent incidents are set in the context of COVID-19, which has heavily and disproportionately impacted people of African descent who faced greater risk and lesser ability to quarantine. These risks, the experts said, have been exacerbated by increased abuse of police authority, over-policing, and excessive force in the enforcement of physical distancing restrictions“.

Los señalamientos y las recomendaciones que plantean los expertos de Naciones Unidas y los mecanismos no convencionales de derechos humanos en ambos comunicados constituyen, sin lugar a duda, un verdadero desafío para las actuales autoridades norteamericanas. Al respecto, merece mención recordar la letra del artículo 2 de la Convención Internacional para la Eliminación del Racismo y de todas las Formas de Discriminación, adoptada el 21 de diciembre de 1965 (véase texto completo), de la que Estados Unidos es parte desde 1994 (véase estado oficial de firmas y ratificaciones), y que se lee como sigue:

Artículo 2

1. Los Estados partes condenan la discriminación racial y se comprometen a seguir, por todos los medios apropiados y sin dilaciones, una política encaminada a eliminar la discriminación racial en todas sus formas y a promover el entendimiento entre todas las razas, y con tal objeto:

a) Cada Estado parte se compromete a no incurrir en ningún acto o práctica de discriminación racial contra personas, grupos de personas o instituciones y a velar por que todas las autoridades públicas e instituciones públicas, nacionales y locales, actúen en conformidad con esta obligación;

b) Cada Estado parte se compromete a no fomentar, defender o apoyar la discriminación racial practicada por cualesquiera personas u organizaciones;

c) Cada Estado parte tomará medidas efectivas para revisar las políticas gubernamentales nacionales y locales, y para enmendar, derogar o anular las leyes y las disposiciones reglamentarias que tengan como consecuencia crear la discriminación racial o perpetuarla donde ya exista;

d) Cada Estado parte prohibirá y hará cesar por todos los medios apropiados, incluso, si lo exigieran las circunstancias, medidas legislativas, la discriminación racial practicada por personas, grupos u organizaciones;

e) Cada Estado parte se compromete a estimular, cuando fuere el caso, organizaciones y movimientos multirraciales integracionistas y otros medios encaminados a eliminar las barreras entre las razas, y a desalentar todo lo que tienda a fortalecer la división racial.

2. Los Estados partes tomarán, cuando las circunstancias lo aconsejen, medidas especiales y concretas, en las esferas social, económica, cultural y en otras esferas, para asegurar el adecuado desenvolvimiento y protección de ciertos grupos raciales o de personas pertenecientes a estos grupos, con el fin de garantizar en condiciones de igualdad el pleno disfrute por dichas personas de los derechos humanos y de las libertades fundamentales. Esas medidas en ningún caso podrán tener como consecuencia el mantenimiento de derechos desiguales o separados para los diversos grupos raciales después de alcanzados los objetivos para los cuales se tomaron“.

En las últimas observaciones hechas por el órgano encargado de verificar el cumplimiento de las disposiciones contenidas en esta convención (el Comité para la Eliminación de Racismo y otras Formas de Discriminación o CERD) con relación al informe oficial remitido por Estados Unidos del 2014 (texto completo disponible en este enlace), se puede leer que dos aspectos específicos dieron lugar a recomendaciones de carácter urgente por parte de los integrantes del CERD:

8. /…/Recalling its general recommendation No. 31 (2001) on the prevention of racial discrimination in the administration and functioning of the criminal justice system, the Committee urges the State party to intensify efforts to effectively combat and end the practice of racial profiling by federal, state and local law enforcement officials, including by:

(a) Adopting and implementing legislation which specifically prohibits law enforcement officials from engaging in racial profiling, such as the End Racial Profiling Act;

(b) Swiftly revising policies insofar as they permit racial profiling, illegal surveillance, monitoring and intelligence gathering, including the 2003 Guidance Regarding the Use of Race by Federal Law Enforcement Agencies;

(c) Ending immigration enforcement programmes and policies, which indirectly promote racial profiling, such as the Secure Communities programme and the 287(g) programme; and

(d) Undertaking prompt, thorough and impartial investigations into all allegations of racial profiling, surveillance, monitoring and illegal intelligencegathering; holding those responsible accountable; and providing effective remedies, including guarantees of non-repetition“.

En otras de sus observaciones, los miembros del CERD urgían a Estados Unidos en los siguentes términos:

17. /…/ The Committee urges the State party to:

(a) Ensure that each allegation of excessive use of force by law enforcement officials is promptly and effectively investigated; that the alleged perpetrators are prosecuted and, if convicted, punished with appropriate sanctions; that investigations are re-opened when new evidence becomes available; and that victims or their families are provided with adequate compensation;

(b) Intensify its efforts to prevent the excessive use of force by law enforcement officials by ensuring compliance with the 1990 Basic Principles on the Use of Force and Firearms by Law Enforcement Officials, and ensure that the new CBP directive on the use of force is applied and enforced in practice;

(c) Improve the reporting of cases involving the excessive use of force, and strengthen oversight of and accountability for inappropriate use of force; and

(d) Provide, in its next periodic report, detailed information concerning investigations undertaken into allegations of excessive use of force by law enforcement officials, including the CBP, as well as their outcomes, including disciplinary or prosecutorial action taken against the perpetrator and remedies provided to victims or their families“.

No cabe duda que estas observaciones del CERD del 2014, al parecer no atendidas debidamente por la administración norteamericana, revisten una actualidad particular en esta primera semana del mes de junio del 2020.
